ExchangeEarth — interim terms of use
These interim terms govern use of the ExchangeEarth platform during its
pre-launch period. The full Terms of Service will replace them once the
operating company is incorporated, and you will be asked to read and accept
those terms before continuing to use the platform.
1. Business users only. The platform is offered only to organisations acting
in the course of a trade, business or profession. By accepting these terms
you confirm that your organisation is doing so, and that you are not using
the platform for purposes wholly or mainly outside a trade, business, craft
or profession. You will provide on request, and keep current, a business
identifier for your organisation (such as a CRO number, VAT number,
registered business name number or herd number).
2. Your own compliance. Your organisation is responsible for its own
compliance with the law that applies to its activities, including the
by-product regime under Article 27 and the EPA's national criteria, the
landfill levy, waste collection permits, planning permissions and
conditions, and any other environmental, transport or tax obligation.
Nothing we supply removes, performs or shares that responsibility.
3. What the platform is. ExchangeEarth supplies software that introduces
sites with surplus material to sites that need it, records your answers to
the eligibility questions, stores documents you choose to attach without
reviewing them, prepares documents in the formats set out in BP-N002/2024,
shows you the values to enter on the EPA register under your own EDEN
account, counts the standstill period, and keeps a tamper-evident record of
each load. ExchangeEarth does not assess, verify or certify any material,
site, registration or answer.
4. Not a party; no funds. Contracts for the supply of material and for
haulage are formed directly between the businesses concerned; ExchangeEarth
is not a party to them and never receives, holds or transmits money on
anyone's behalf.
5. Records. Records the platform creates are appended rather than
overwritten: corrections are new, visible entries, and your organisation can
export its own records.
6. Accounts. Every person using the platform must accept these terms before
substantive use, including people invited by another organisation. We may
suspend or close accounts used in breach of these terms; if we do, we will
tell you the facts and grounds relied on and the way to complain.
